1. Acceptance of Terms

By accessing and using the Roofing Rick website ("Site") or engaging our roofing services ("Services"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our Site or Services. These Terms constitute a legally binding agreement between you and Roofing Rick ("Company," "we," "us," or "our").

2. Services Provided

Roofing Rick provides residential and commercial roofing services including, but not limited to, roof inspections, repairs, replacements, installations, emergency tarping, gutter installation, and related exterior contracting work. All services are performed in accordance with applicable local, state, and federal building codes and regulations across all 50 United States.

3. Licensing and Compliance

Roofing Rick maintains all necessary licenses, permits, and registrations required by applicable state and local jurisdictions in which we operate. Roofing regulations, contractor licensing requirements, and permitting processes vary by state and municipality. We comply with all applicable licensing laws, including but not limited to:

  • State contractor licensing requirements (where applicable)
  • Local building permit requirements for roofing work
  • OSHA (Occupational Safety and Health Administration) safety standards
  • EPA (Environmental Protection Agency) regulations, including lead paint and asbestos handling where applicable
  • State Home Improvement Contractor registration requirements
  • State-specific consumer protection and home solicitation statutes

Customers are encouraged to verify our licensing status with their state's contractor licensing board. Licensing information will be provided upon request.

4. Estimates, Proposals, and Contracts

All roofing work is subject to a written estimate or proposal provided prior to the commencement of work. Estimates are valid for 30 days from the date of issuance unless otherwise stated. A separate written contract or work authorization must be signed by the Customer before any work begins. The written contract shall govern the specific terms of each project and, in the event of a conflict, shall take precedence over these general Terms of Service.

Estimates are based on visible conditions at the time of inspection. Additional costs may arise due to hidden damage, structural deficiencies, code compliance requirements, or unforeseen conditions discovered during the course of work. Any additional costs will be communicated to the Customer for approval before proceeding.

5. Right to Cancel

In accordance with the Federal Trade Commission's (FTC) Cooling-Off Rule (16 CFR Part 429) and applicable state consumer protection laws, Customers who enter into a contract for roofing services as a result of a door-to-door sale have the right to cancel the contract within three (3) business days of signing. Some states provide extended cancellation periods. We will provide all required cancellation notices as mandated by applicable state law, including but not limited to:

  • California: Five (5) business days for contracts resulting from home solicitation (Cal. Civ. Code § 1689.5–1689.14)
  • Texas: Three (3) business days (Tex. Bus. & Com. Code § 601.052)
  • Florida: Three (3) business days (Fla. Stat. § 501.021–501.055)
  • Other states: As required by applicable state statutes

Emergency repairs requested by the Customer may waive cancellation rights where permitted by law, provided a written waiver is signed.

6. Insurance

Roofing Rick maintains comprehensive general liability insurance, workers' compensation insurance (as required by state law), and any other insurance required by applicable state and local regulations. Certificates of insurance will be provided upon request. Customers are responsible for maintaining their own homeowner's or property insurance. We are not responsible for filing insurance claims on behalf of the Customer, though we may assist with documentation as a courtesy.

7. Warranties

Roofing Rick provides workmanship warranties as specified in each individual project contract. Manufacturer warranties on materials are separate from our workmanship warranty and are subject to the terms and conditions of the respective manufacturer. Warranty terms vary and will be clearly stated in the project contract.

Warranties may be voided by unauthorized modifications, failure to maintain the roof, damage caused by natural disasters or Acts of God, or failure to address known issues in a timely manner. Some states impose implied warranty obligations on contractors that cannot be waived; in such cases, those statutory warranties apply in addition to any express warranties provided.

8. Payment Terms

Payment terms are specified in the individual project contract. A deposit may be required prior to the commencement of work. In states that limit the amount of deposit a contractor can collect (e.g., California limits deposits to $1,000 or 10% of the contract price, whichever is less, per Cal. Bus. & Prof. Code § 7159), we comply with all applicable deposit limitations.

Final payment is due upon completion of work unless otherwise agreed. Late payments may be subject to interest charges as permitted by applicable state law. We reserve the right to file a mechanic's lien on the property in accordance with applicable state lien laws if payment is not received for completed work.

9. Mechanic's Liens

In the event of non-payment for services rendered, Roofing Rick reserves the right to file a mechanic's lien (also known as a construction lien or materialman's lien, depending on the state) against the Customer's property in accordance with applicable state law. Lien filing requirements, deadlines, and procedures vary by state. We will provide all required preliminary notices and lien waivers as mandated by applicable state statutes.

10. Permits and Inspections

Roofing Rick will obtain all necessary building permits required for the scope of work, unless otherwise agreed in writing. The cost of permits is included in the project estimate unless stated otherwise. We will coordinate all required inspections with local building authorities. The Customer agrees to provide reasonable access to the property for inspections. Final approval from the local building department may be required before the project is considered complete.

11. Environmental Compliance

Roofing Rick complies with all federal, state, and local environmental regulations, including:

  • EPA's Renovation, Repair, and Painting (RRP) Rule for structures built before 1978 that may contain lead-based paint
  • Proper disposal of roofing materials in accordance with state and local waste disposal regulations
  • Asbestos handling and abatement regulations (where applicable), including compliance with the National Emission Standards for Hazardous Air Pollutants (NESHAP)
  • Stormwater management and erosion control requirements

12. Safety and Worksite Conduct

Roofing Rick adheres to all OSHA fall protection standards (29 CFR 1926 Subpart M) and other applicable safety regulations. We maintain a safe worksite and carry workers' compensation insurance as required by state law. Customers and unauthorized persons should not enter the active work area during construction for safety reasons.

13. Property Access and Damage

The Customer grants Roofing Rick permission to access the property and surrounding areas as reasonably necessary to perform the contracted work. We will take reasonable precautions to protect landscaping, personal property, and the structure during the course of work. Any pre-existing damage will be documented prior to commencement. We are responsible for damage directly caused by our negligence but are not liable for damage resulting from pre-existing conditions, normal wear, or conditions beyond our control.

14. Force Majeure

Roofing Rick shall not be liable for delays or failure to perform caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, pandemics, supply chain disruptions, labor shortages, government actions, or other Acts of God. In such events, project timelines will be extended accordingly and we will communicate any delays promptly.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Roofing Rick's total liability for any claim arising out of or related to these Terms or our Services shall not exceed the total amount paid by the Customer for the specific project giving rise to the claim. In no event shall Roofing Rick be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Some states do not allow the exclusion or limitation of certain damages. In such states, our liability is limited to the fullest extent permitted by law.

16. Indemnification

The Customer agrees to indemnify and hold harmless Roofing Rick, its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from the Customer's breach of these Terms, misuse of the Site, or any false or inaccurate information provided by the Customer.

17. Dispute Resolution

In the event of a dispute arising out of or relating to these Terms or our Services, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation fails, the parties agree to submit to mediation before a mutually agreed-upon mediator. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless prohibited by applicable state law.

Some states require specific dispute resolution procedures for home improvement contracts. In such states, those procedures shall apply. Nothing in this section shall prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which the roofing project is performed, without regard to conflict of law principles. For matters involving the Site only (without an associated roofing project), these Terms shall be governed by the laws of the State of Washington.

19. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Roofing Rick or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission.

The information provided on this Site is for general informational purposes only and does not constitute professional advice. While we strive to keep the information accurate and up to date, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the Site or the information contained therein. Any reliance you place on such information is strictly at your own risk.

21. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

22. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

23. Entire Agreement

These Terms, together with any individual project contracts and our Privacy Policy, constitute the entire agreement between you and Roofing Rick with respect to your use of the Site and our Services, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Roofing Rick.

24. Changes to Terms

Roofing Rick reserves the right to modify or replace these Terms at any time at our sole discretion. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site or Services after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
